1. Acceptance of Terms

By accessing or using JingleJams ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

JingleJams is a platform that uses artificial intelligence to generate personalized songs and music videos. Users can create custom jingles by providing text prompts and optionally upload photos to generate animated or lip-synced video content.

3. User Accounts

You may use certain features without an account. To access full functionality including saving, sharing, and purchasing credits, you must create an account through our authentication provider (Clerk). You are responsible for maintaining the security of your account credentials.

4. Credits and Payments

The Service operates on a credit-based system. Credits can be earned through daily free claims or purchased through our credit packs. All purchases are processed securely through Stripe. Credits do not expire. All sales are final — we do not offer refunds on purchased credit packs, except where required by law.

5. User-Generated Content

You retain ownership of any photos, text, or other content you upload to the Service ("User Content"). By uploading content, you grant JingleJams a non-exclusive, worldwide, royalty-free license to use, process, and transform your content solely for the purpose of providing the Service (e.g., generating videos from your photos).

You represent and warrant that you have the right to upload any content you provide, including the right to use any person's likeness in photos you upload. You must not upload content that:

• You do not have permission to use
• Contains images of minors without parental consent
• Is illegal, defamatory, obscene, or violates any third party's rights
• Is intended to harass, bully, or harm any person
• Impersonates another person without their consent

6. AI-Generated Content

Songs, lyrics, images, and videos generated by the Service are created using artificial intelligence. You receive a license to use AI-generated content for personal, non-commercial purposes. For commercial use, please contact us. We do not guarantee the accuracy, quality, or appropriateness of AI-generated content.

7. Photo Upload Consent

When you upload a photo of a person to create a video, you confirm that:

• You have obtained consent from the person(s) depicted, or you are the person depicted
• The photo is not of a minor, or you are the parent/legal guardian providing consent
• You understand the photo will be processed by AI to generate animated or lip-synced video content
• You accept responsibility for how you share or distribute the resulting video

8. Prohibited Uses

You agree not to use the Service to:

• Create deepfakes or misleading content intended to deceive
• Generate content that is harassing, threatening, or hateful
• Violate any applicable law or regulation
• Infringe on any third party's intellectual property rights
• Attempt to reverse-engineer or exploit the Service

9. Limitation of Liability

The Service is provided "as is" without warranties of any kind. JingleJams shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes through the Service. Continued use after changes constitutes acceptance of the new terms.
